Bankruptcy Purchases
If you have received a postcard in the mail warning you about your bankruptcy status, it means that your chapter 7 or 13 bankruptcy has already been dismissed by the bankruptcy court! Bankruptcy case information is available to the public, and accessible over the internet (that's how I found out your contact information and case status). Your next move should be to contact your attorney (or the bankruptcy court), and have your attorney explain to you, what the dismissal means to your financial situation. Generally speaking, a dismissal means that you failed to comply with the formalities of the bankruptcy process and the court has kicked you out of bankruptcy. A dismissal is an unsatisfactory outcome to a bankruptcy. This means, you are no longer under the protection of the bankruptcy court; therefore, your creditors are free to sue you in civil court, get judgments against you, garnish your wages, repossess your belongings, levy any assets you have, and foreclose on your house. You lost your bankruptcy protection because any one of following reasons:
- You didn't file a list of all of your creditors
- You didn't pay all of your bankruptcy court fees
- You didn't make your court approved payment plan.
- You abused the protection of the bankruptcy court system.
- You misrepresented your personal or financial information.
What should you do now?
Now, you have a simple question to answer: "Are you willing to do what's necessary to stop the foreclosure and auction of your house?" I can stop the foreclosure, but I will need your complete cooperation while I negotiate with your lender. All information you provide MUST be the complete truth regarding your financial condition. You MUST be willing to sell me your house "subject to" the existing liens, and move out of the house, within 30 days. NO MORE dragging your feet or making excuses! At this point, you're going to lose your house anyway, so you might as well leave before your lender evicts you! Move out with dignity - moving money is available! I cannot, and I will not, promise you that I can stop the foreclosure; but you have nothing to lose by trying to get a "short sale" accepted by your lender.
